ELIGIBILITY:
Participation constitutes full and unconditional agreement to, and acceptance of, these Official Rules. The Perpetual Vogue, Tattoo Apparel Model Search Contest is open to legal residents of the United States, who are 21 years of age or older (or will be 21 years of age by December 16, 2010) and reside in a State that permits this type of contest. Void where restricted or prohibited by law. It is the entrants responsibility to know what contests are legal to enter in their State of residence. Employees and officers of Perpetual Vogue, TattooApparel.com or any of the listed contest sponsors or their immediate family members and persons living in their same household are not eligible to enter. Anyone who has previously modeled for Perpetual Vogue or TattooApparel.com is not eligible to enter. This Contest is offered in the U.S. only and shall only be construed and evaluated according to U.S. law. Residents of States that prohibit such contests are ineligible. To enter you MUST be able to travel to Southern California to receive prizes and take part in a Photo Shoot during the required dates, January 22, 2011 through January 26, 2011.
The Contest is governed by the laws of the State of California. By entering,
entrants and winners agree (a) to release the Sponsor and its agents from all liability, loss or
damage arising out of or relating to the participation of entrants and winners in the Contest,
including with respect to their acceptance and use or misuse of the prizes (b) to be bound by
these Official Rules (c) that the decision of the Sponsor is final and binding on all matters
relating to the Contest and (d) to the use of their names, biographical information and likenesses
for advertising and promotional purposes in all media worldwide (including the Internet)
without additional compensation. By participating in the Contest, entrants agree to abide by and be bound by these Official Rules, and understand that the Contest results are final in all respects. By participating in the Contest, entrants agree to hold Sponsor and its managers, employees,
agents, licensees, successors and assigns, harmless from and against any and all claims, injuries or liability arising out of such participation including any injury that occurs during the travel, location visit or entertainment portion of the prizes or from product usage. Sponsor does not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability and fitness for a particular purpose.
All applicable federal, state and local laws and regulations apply.
All winners will be issued an IRS 1099 tax form for the actual tangible value of physical prizes awarded. Winners are responsible for any federal, state and local taxes that may be required by law.
All winners must submit an Affidavit of Eligibility, Release of Liability and Prize Acceptance Form immediately upon being chosen. If the contestant cannot be reached by telephone within two days of being chosen as a winner or if after being reached by telephone the signed affidavit and, or release is not returned to the Sponsor within two (2) business days such winner will be disqualified and an alternate winner will be chosen. Noncompliance with these Official Rules or inability to travel on the require dates shall result in disqualification and TattooApparel.com will award the prizes to an alternate winner of their choice. By accepting prizes, winners consent that Sponsor may use the winners name, image (including but not limited to
photographs, videos and other likenesses), biographical information and statements
concerning the Contest, without compensation in connection with advertising, promotion and
merchandising, and winners irrevocably grant the right to edit or modify and to publish and
copyright the foregoing. Winners must also make themselves available to travel
to Southern California on the required date for a photo shoot as part of the prize package. By entering the contest entrants are agreeing that they will be available to travel and participate on the listed dates. If a chosen winner later states that they cannot travel to Southern California and/or take part in the photo shoot on the required dates then they will forfeit all prizes and another winner will be chosen. By accepting prizes, winners agree to hold Sponsor and
its managers, employees, agents, licensees, successors and assigns, harmless from and
against any and all claims and liability arising out of any and all prizes. Winners assume all
liability for any injury or damage caused, or claimed to be caused, by participating in the Contest. By participating in the Contest, entrants agree to abide by and be bound by all rules and contest terms.
GENERAL RULES OF CONTEST
Only one entry per person is allowed. To enter the Contest you must register online, accept the contest rules and must submit a current, unedited photograph of yourself. Nude photos or photos that are pornographic or graphic in nature will not be accepted. Please submit a tasteful photograph as we will review photos before accepting them and posting them on our web site as part of the contest. We reserve the right to refuse an entry that includes a photo that is deemed to be inappropriate. Please choose a photo that is a true and factual representation of your appearance. You do not have to be a professional model and the photo does not have to be a professionally shot photograph. To show well the photograph should be of high resolution. 250 dpi or higher works best. The photo must be an individual shot of you, not a group shot that you are part of. You will enter your address, contact information, clothing sizes and other information on the online contest entry form. Once the entry is accepted we will post the entrants photograph, name and general geographic location on the Photo Gallery for the Model Search Contest. We will not publically post entrants actual Street Addresses, email addresses or Telephone Numbers on the contest site.
By submitting a photograph you hereby grant to Perpetual Vogue, TattooApparel.com and other sponsors of the Perpetual Vogue, Tattoo Apparel Model Search a non-exclusive, royalty-free, worldwide, limited license to the copyright of the photograph, and to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such content including without limitation distributing part or all of the Site in any media formats through any media channels. Perpetual Vogue, TattooApparel.com and others may copy, print of display publicly available Content outside of the Contest web pages, including without limitation, via the Site or third party websites or publications, and you agree not to raise any claim or dispute based on any right to privacy for the entrant against Perpetual Vogue, TattooApparel.con or any others based on your participation in the Contest.
Entrant must be the owner of the photograph, and have the right to submit the photograph for consideration in the Contest. Entrant must own the copyright for the photograph or have acquired an assignment of the copyright from another who provided the photograph, such as the photographer. Submitted photographs should not be digitally or otherwise altered. By submitting a photograph you are stating that the image is a recent photograph of yourself and that you own or have the right to use the photograph. Submitting a photograph of someone other than yourself or a photo that you do not have the right to use is against the contest rules and will result in a forfeiture of any and prizes should you be chosen as one of the contest winners.
All other required entrant information including but not limited to Contact Information, Address, Age and Clothing Sizes must be truthfully completed on the contest entry. Incomplete entries will not be processed. Factual Clothing Sizes are important as clothing prizes will be supplied based on the size listed on the winnerâs entry and items will not be available for size exchanges.
All rules, rule interpretations, disqualifications, prize awards, and all other aspects of the Contest will be decided by Perpetual Vogue and TattooApparel.com based solely on Perpetual Vogue and TattooApparel.coms judgment.
The entrant indemnifies Perpetual Vogue, TattooApparel.com, other contest sponsors or their assigns for any and all costs associated with a claim, suit, or threat of claim based on the publication of any image entered in the Contest, including all reasonable legal costs.
Businesses, individuals and,or organizations partnering with Perpetual Vogue and TattooApparel.com for any reason, including but not limited to contest promotion, prize providers and service providers are the be considered sponsors with same rights and protections as Perpetual Vogue and TattooApparel.com under these rules.
Entrant must be available to travel to Southern California to receive prizes and take part in a photo shoot for Perpetual Vogue and TattooApparel.com on the required dates. Travel to Southern California will take place on Saturday January 22, 2011 with return travel on Wednesday, January 26th. The Photo Shoot is scheduled for Monday, January 24, 2011. Winners must make themselves available for the photo shoot and events January 22nd, 23rd and 24th, 2011. Winners will have a free day to enjoy Southern California on their own on Tuesday, January 25th before they return home on Wednesday, January 26th.
HOW TO ENTER
Enter online on the contest page on TattooApparel.com and complete the registration form. Provide all requested information in the required fields contained in the entry form, along with uploading your photo. Online entries will be accepted throughout the duration of contest, October 16, 2010 through December 16, 2010. One male and one female winner will be chosen by Perpetual Vogu, TattooApparel.com and winners will be notified by December 18, 2010. Winner must fill out and return an Affidavit of Eligibility, Release of Liability, Prize Acceptance Form within two business days of being chosen or they forfeit all prizes and an alternate winner will be chosen. Two female and two male alternate, runner ups will be chosen. Runner Ups will receive a $100.00 TattooApparel.com Gift Card and if a winner is disqualified Perpetual Vogue, TattooApparel.com reserves the right to name one of the Runner Ups as the new Contest Winner. If a chosen winner and all runner ups are disqualified or unable to travel as required Perpetual Vogu, TattooApparel.com reserves the right to then choose a new winner from the contestant pool. If the Contest Winner is unable to fulfill the Eligibility Requirements they will then forfeit the Winning Prize Package and a new winner will be chosen by Perpetual Vogue, TattooApparel.com. If a Runner Up is chosen to take the place of one of the main winners who forfeit their prize package then the Runner Up will receive the Main Winner Prize Package instead of the Runner Up prizes.
AWARDS, PRIZES
Awards may NOT be redeemed or exchanged for retail or cash value of any kind.
Two Grand Prize Winners (one male and one female) will take part in a fashion shoot with a professional photographer for Perpetual Vogue and TattooApparel.com including professional hair and makeup services. Winners will be supplied with a disk of all of their digital images from the photo shoot which they can use with limited rights for their own portfolio and personal use only. Winners will have to sign a Model Release for Perpetual Vogue, TattooApparel.com, other contest sponsors and the Photographer. Perpetual Vogue, TattooApparel.com and their assigns retain all rights to the photographs which will be used for marketing, promotion and product sales purposes.

Winners receive one economy roundtrip airline ticket in their name from a major airport in their area to a Southern California Airport (airport to be chosen by Perpetual Vogue, TattooApparel.com). IF the winner is a Southern California resident they will be awarded $150.00 cash for travel expenses instead of airline tickets. An agent from Perpetual Vogue, TattooApparel.com will pick the winner up at the airport and transport them to their hotel. Should the contest winner choose to have a companion accompany them they will do so at their own expense for travel costs.
Each qualified Winner will receive a prepaid Hotel Room at a Hotel in Southern California that is near the Perpetual Vogue Southern California for four nights, starting January 22nd. Perpetual Vogue, TattooApparel.com reserve the right to choose the Hotel which will be located within 15 miles of the Perpetual Vogue Store, TattooApparel.com Warehouse (the Hotel will most likely be in the Brea or Anaheim area). This includes hotel room and room tax on the room rate for those four nights. Winner is responsible for any additional or incidental charges and the hotel may require a credit card at check in to cover any additional charges the winner chooses to incur during their stay. The prepaid Hotel Room will allow one extra person in the room for no additional fee if the Winner has a companion with them. By entering this contest the Winner agrees that they are financially responsible for any damage they may cause to the hotel room or hotel premises.
Perpetual Vogue,TattooApparel.com or Sponsor Staff will provide transportation on January 22nd through January 24th to and from schedules events. Meals will be provided January 22nd through January 24th. Winners will have a day on their own on January 25th to do as they like at their own expense. Perpetual Vogue,TattooApparel.com will provide transportation to the airport for the return flight on January 26th.

Perpetual Vogue,TattooApparel.com will choose 3 pair of shoes or boots from current T.U.K. inventory in styles that will, in Perpetual Vogue, TattooApparels opinion work well with the other fashions to be photographed in the Photo Shoot. Evening Entertainment
During two nights of their stay Perpetual Vogue, TattooApparel.com will take the winners out for the evening to local entertainment venues. One evening will be spent at the World Famous Brea Improv Comedy Club and another night will be at the Anaheim House of Blues. Locations may be subject to change due to availability.
WINNER NOTIFICATION
Perpetual Vogue, TattooApparel.com will contact all potential winners in accordance with the information supplied on their Entry Forms. Winners will be contacted over the telephone to verify their entry and then sent the Affidavit of Eligibility, Release of Liability, Prize Acceptance Form which needs to be returned within two days time as per the contest rules. If Sponsors are unable to communicate directly with a winner by telephone within two (2) days from initial attempted notification or if the winner does not return the required forms within (2) days, Sponsors at their sole discretion may disqualify that winner and select an alternate winner using the same winner selection method set forth above. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules. Upon verification of eligibility, the names and, or photographs of the First Place Winner and Runner Up Winners will be posted on the Contests web site page and travel will be arranged. Material Prizes are awarded in person when the contest winner is in Southern California on the required dates to take place in the Perpetual Vogu, TattooApparel.com photo shoot.

MISCELLANEOUS
All federal, state and local laws apply. Perpetual Vogue, TattooApparel.com, the Sponsor shall be entitled to interpret these rules as needed, including but not limited to rules regarding entries, selection of winners, deadlines, restrictions on awards, and eligibility and all of their decisions are final. By entering, Entrants agree to these Official Rules. Sponsor reserves the right to cancel, terminate or suspend this Contest or any part of this Contest at any time and for any reason, including but not limited to any non authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, corruption or impairment of the security, administration, fairness and, or operation of this Contest, as determined by Sponsor at their sole discretion. Perpetual Vogue, TattooApparel.com retains the right to select the Winners in accordance with any criteria deemed appropriate at the sole discretion of the Sponsor, from among all non suspect eligible entries received at the time of the Contest termination. Sponsors are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, even if the failures or disruptions are due to Sponsor errors, or for entries that for any reason are not received by Sponsors by the deadlines stated above. Sponsors are also not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this Contest or downloading of any software or materials. Sponsors reserve the right to correct typographical or clerical errors in any Contest related materials. No more than the stated number of awards will be available. In the event that production, technical, programming or any other reasons cause more than the stated number of awards as set forth in these Official Rules to be available and, or claimed, Sponsors reserve the right to provide only the stated number of awards by selecting the Winners using any criteria deemed appropriate at the sole discretion of the Sponsor.
Perpetual Vogue, TattooApparel.com will NOT be responsible for the inability to select winners because of equipment failure, or data storage failure.
Sponsors reserve the right to prohibit any Entrant from participating in the Contest if, at their sole discretion, Sponsors find such Entrant to be tampering with the entry process or the operation of the Contest, or if such Entrant repeatedly shows a disregard for, or attempts to circumvent, these Rules, or acts (a) in a manner Sponsors determine to be not fair or equitable (b) with an intent to annoy, threaten or harass any other Entrant or Sponsors or (c) in any other disruptive manner as determined by the Sponsor. Any person attempting to defraud or tamper with this Contest in any way will be ineligible to participate or receive an award and may be prosecuted to the full extent of the law. Any failure by the Sponsors to enforce any of these Rules shall not constitute a waiver of such Rules.
Entrants agree to release Perpetual Vogue, TattooApparel.com and all Contest Sponsors from any and all liability or damages related to this Contest.
Perpetual Vogue, TattooApparel.com and other sponsors reserve the right to substitute prizes of equal value if any the named prizes become unavailable for any reason.
DISPUTES
By entering the Contest, Entrants agree to all of the contest rules and agree that the winners are chosen at the sole discretion of Perpetual Vogue and TattooApparel.com and that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any awards shall be resolved individually, without resort to any form of class action (b) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Contest but in no event attorneys fees and (c) under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of California. Any legal proceedings arising out of this Contest or relating to these rules shall be instituted only in the federal or state courts located in Orange County, California and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
